What is GDPR?
The General Data Protection Regulation (GDPR) is a privacy law that allows EU and UK citizens and residents to have access and control over their personal data. The UK has implemented this through the UK GDPR and Data Protection Act 2018.
Is HeySurvey GDPR Compliant?
Yes. HeySurvey is operated by Cene Technologies Ltd, based in the United Kingdom, and complies with the UK GDPR framework.
These are the measures we have taken:
- Our privacy policy gives you detailed information about what data we collect, data retention and transfers, and outlines your data protection rights
- All HeySurvey data is encrypted both in transit and at rest
- Data accessibility: you have full control of the information you collect, store and manage with HeySurvey
- Formal Data Processing Agreements are available for organisations upon request
Do you have a Data Processing Agreement?
HeySurvey is currently in alpha. By agreeing to our Terms of Service through the creation of your HeySurvey account, you accept our data processing practices as outlined in our Privacy Policy and Terms of Service.

What happens with survey data?
HeySurvey is the provider of a survey service, and not the owner of the collected survey responses. The survey creator is responsible for the data they collect and is thus data controller of the respondent data. HeySurvey is the processor and stores information on behalf of the survey creators.
As long as your account is active, you (as the survey creator) have full control over the data you collect and the time period for which you store the data:
- You are able to delete or export survey responses from your account at any time
- We honour all deletions, and all survey data which has been deleted by you is permanently deleted from our backups within 90 days
- Voice recordings and transcriptions are processed securely and can be deleted upon request
How do you use my personal data?
HeySurvey acts as a data controller in the relationship between HeySurvey and our customers (survey creators), for the personal information you give us in order to use our service (registration information for example).
HeySurvey does not sell personal data to third parties or use it for marketing purposes or for serving advertisements. We only share your information with our service providers who help us operate our business, in which case those third parties are required to comply with the GDPR framework.

Account data is retained while your account is active and for a reasonable period thereafter. Survey response data retention is determined by the survey creator's settings.

By accessing or using HeySurvey ("the Service"), operated by Cene Technologies Ltd ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms" or "Agreement"). If you do not agree to these terms, please do not use the Service.

- Data loss may occur, and we recommend maintaining your own backups
- Performance may vary as we continue development
4. Description of Service
HeySurvey is an AI-powered voice survey platform that enables users to create, distribute, and analyse conversational surveys. The Service includes web applications, APIs, and related tools.
5. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access
- Accept responsibility for all activities under your account
6. License Grant
License to You

By uploading or creating User Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display your User Content solely as necessary to provide and improve the Service. This licence terminates when you delete your User Content or Account, except where retention is required by law or for legitimate business purposes.
Feedback
If you provide us with any suggestions, comments, or feedback regarding the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, royalty-free licence to use such Feedback for any purpose without compensation or attribution to you.
7. Acceptable Use
You agree not to use the Service to:

9. Limitation of Liability
To the maximum extent permitted by law, Cene Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or £100, whichever is greater.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Indemnification
You agree to indemnify and hold harmless Cene Technologies Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
Upon termination, all licences granted to you under these Terms shall immediately cease. Sections that by their nature should survive termination shall survive, including but not limited to: Definitions, License Grant (Your Content, Feedback), Limitation of Liability, Disclaimers, Indemnification, and Miscellaneous Provisions.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or by email. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you disagree with any changes, you must stop using the Service and may terminate your Account.
14. Miscellaneous Provisions
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Cene Technologies Ltd regarding the Service and supersede all prior agreements, negotiations, and understandings.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
Waiver
No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise of any right preclude any other or further exercise of that right or any other right.
Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, or pandemics.
No Third-Party Beneficiaries
These Terms do not confer any rights on any third party unless expressly stated otherwise.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
